2. The petitioner has prayed for bail in connection with Shastri Nagar P.S. Case No.835 of 2025 registered for the offence punishable under Section 304(2) of the BNS.

3. The case of the prosecution, in short, is that some unknown miscreants have snatched golden chain of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that FIR was lodged against unknown miscreants. Learned counsel for the petitioner has submitted that the petititoner was apprehended in Rajeev Nagar P.S. Case No. 761 of 2025 wherein he has given his confessional statement. It has further been submitted that nothing has been recovered from

Patna High Court CR. MISC. No.40582 of 2026(2) dt.25-06-2026 2/3 the possession of this petitioner. Save and except confessional statement, there is nothing against the petitioner. It has further been submitted that in this case, charge-sheet has been filed and no TIP was conducted by the I.O. Learned counsel for the petitioner has submitted that petitioner is in judicial custody since 16.02.2026.

5. The application for bail is opposed by learned APP for the State. It has further been submitted that the petitioner is having criminal antecedent of 18 cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the following conditions:- (i) the petitioner shall co-operate in the trial; (ii) shall remain physically present on each and every date;

(iii) one of the bailors shall be near relative of the petitioner and (iv) the petitioner shall mark his weekly attendance at Rajeev Nagar P.S.

7. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten
