Petitioner seeks bail in a case registered under Sections 147, 148, 149, 302, 379 of Indian Penal Code. Petitioner's counsel claims parity with other coaccused Devo Singh @ Devendra Singh and Subodh Singh, who have been enlarged on bail by this Court in Cr Misc No 60851 of 2017 and Cr Misc No 7070 of 2018. He submits that the general allegation of indiscriminate firing was common to the said accused persons including the instant petitioner. The other two cases, which are pending against the petitioner, details of which have been mentioned in paragraph 3, it is submitted that the petitioner is on bail. He is in custody in this case since 18.10.2017.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Naugachia, Bhagalpur in Sessions Trial No 42 of 2018 arising out of Bihpur Police Station Case No 353 of 2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
