JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the daughter of the sister of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 387, 504, 498A and 307/34 of the Indian Penal Code. It is alleged that the informant who belongs to scheduled caste performed love marriage with one Ashwin Kumar in the year 2008, subsequently she was blessed with two children but after several years of the marriage, the behaviour of the husband of the informant got changed and he started inflicting torture upon the informant. Accusation against the petitioner is that she assaulted the informant.

It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner and there is no injury report on record. The occurrence took place inside the

Patna High Court Cr.Misc. No.22740 of 2015 (2) dt.13-05-2015 2/2 house which cannot be treated to be a place of public view. Moreover, the informant has retracted from her initial version and filed a petition to that effect before the learned court below and considering the same, husband of the informant has been granted bail.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Town P.S. Case No. 657 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
