The petitioner being the mother of husband of the victim renewed prayer for anticipatory bail in registered for the offences punishable under Sections 498A/304B/201/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The accusation is of killing the daughter of the informant within three months of marriage for non-fulfillment of dowry demand and dead body was disposed of in haste. The prayer for anticipatory bail has been renewed on the ground that the informant has retracted from initial version and has filed a petition to that effect before the learned court below. The same has been brought on record as annexure - 3 to the petition and husband of the victim has been granted regular
Patna High Court Cr.Misc. No.13422 of 2015 (2) dt.06-05-2015 2/2 bail. Moreover, the petitioner is suffering from serious ailment. Considering the fact that on merits the anticipatory bail of the petitioner was rejected, this Court is not inclined to entertain the present application.
But keeping in view of the retracted version of the informant and husband of the victim has been granted regular bail, it is a fit case for consideration of regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Ara Muffasil P.S. Case No.225 of 2013, pending before the Judicial Magistrate, 1st Class, Bhojpur, Ara.
With the above observation, this application is, accordingly, disposed off.
