JUSTICE BIRENDRA KUMAR ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 354A(i) of the Indian Penal Code and Section 8 of the Prevention of Children From Sexual Offences Act.

Allegation against the petitioner is that he was tutor of the daughter of the informant and he was indulged in sexual harassment of the daughter of the informant. The parties have entered into the compromise and the impugned order reveals that the victim had not given her statement to the police. Considering the aforesaid fact, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.20258 of 2017 (2) dt.01-05-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Patna/Successor Court, in connection with Special (POCSO) Case No. 21 of 2017, arising out of Pirbahore P.S. Case No.44 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
