JUSTICE RAKESH KUMAR ORAL ORDER 10-04-2015 Heard Sri Rajendra Narayan, learned senior counsel, who was assisted by Mr. Arun Kumar, learned counsel for the petitioner and Sri Shyam Kumar Singh, learned A.P.P. The sole petitioner, apprehending his arrest in connection with Suryagarha ( Manikpur) P.S. Case No.75 of 2014, registered for the offence under Section 302/ 201/120(B) of the Indian Penal Code has prayed for grant of anticipatory bail. It was submitted by learned senior counsel for the petitioner that F.I.R. was lodged against unknown, however, during investigation only on the plea that the deceased was having illicit relation with the sister of the petitioner, petitioner name has transpired as an accused and he has been implicated in the present case.

In view of the facts and circumstances particularly the fact that F.I.R. was lodged against unknown, the court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, the petitioner namely Ravi Kumar shall be released on furnishing bail bond of Rs. 10,000 /- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Suryagarha (Manikpur) P.S. Case No. 75 of 2014 subject to conditions contemplated under Section 438(2) of the Cr.P.C. with condition that during investigation the petitioner shall render full co-operation to the Investigating Officer of the case. It is further clarified that if after investigation accusation against the petitioner is found true and charge sheet is submitted, the petitioner will have to surrender and make a prayer for regular bail.
