JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have established physical relation with the informant on false pretext of marriage but written report of the informant goes to show that the negotiation of marriage of the informant with the petitioner was going on prior to establishment of his physical relation .Moreover, the informant was major at the time of alleged occurrence and the impugned order of the learned 1st Additional Sessions Judge, Hilsa (Nalanda) goes to show that in course of investigation, some witnesses stated that the informant has brought this case against the petitioner to pressurize him for marriage.
Patna High Court Cr.Misc. No.33991 of 2016 (2) dt.19-08-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S.Case no. 187 of 2014.
