JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Both the above stated petitions have arisen out of Madhwapur P.S. Case No. 28 of 2015 registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 504, 364 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.
Patna High Court Cr.Misc. No.37049 of 2016 (3) dt.25-10-2016 2/2 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report with specific allegation that they and other F.I.R. named accused took the informant's brother whose dead body was later on recovered. However, it appears that having similar allegation, prayer for bail of other accused has already been rejected by different Benches of this Court.
Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioners on bail and hence, their prayer for bail in connection with Madhwapur P.S. Case No. 28 of 2015 pending in the court of learned Judicial Magistrate 1st Class, Benipatti, Madhubani stands rejected.
However, the trial of the petitioners should be expedited.
