JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

The prosecution case is that the complainant's son was working at Delhi who transmitted `40,200/- to the complainant through the bank account of co-accused Mithilesh Kumar when the petitioner being the brother of Mithilesh Kumar called the complainant to receive the money but the same was not given. Considering the fact that the accusation is specific against Mithilesh Kumar, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from

Patna High Court Cr.Misc. No.23106 of 2015 (2) dt.13-07-2015 2/2 today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheikhpura in connection with Complaint Case No. 32C of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
