1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 149, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioner no.1 has antecedent of four cases, petitioner no.2, 4, 5, 7 , 8, 11 and 12 have antecedent of one case and petitioner no.3, 6 and 9 have antecedent of two cases and the informant alleges that on 13.11.2023 he along with his family members were sitting at the door when all the named accused persons including the petitioners came variously armed and Mantosh Ram assaulted Umesh by Garasha, causing injury on head, thereafter, Santosh Ram and Rakesh Ram by lathi assaulted Jitendra and Ajay and Anil snatched Rs.2000/- from the pocket of the informant. It is next submitted that petitioners have been falsely implicated in the instant case. It is next submitted that Kargahar P.S. Case No.422/2023 and Kargahar P.S. Case No.471/2023 came to be instituted from the side of the petitioners against the informant. It is also submitted that the injury suffered by the injured is simple in nature, as would manifest from Annexure-4 series to the anticipatory bail application. It is next submitted
Patna High Court CR. MISC. No.44624 of 2024(2) dt.19-08-2024 3/3 that the entire family members have been implicated with general and omnibus allegation. It is also submitted that no reason for the occurrence is alleged in the F.I.R., which casts an aspersion on the case of prosecution.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Kargahar P.S. Case No.421/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
