The petitioner has renewed his prayer for bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 20 litres of country liquor was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 1.4.2022 (Annexure-2) passed in Cr. Misc. no. 53803 of 2021 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody for more than one year since 11.7.2021. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and

No.39816 of 2022(2) dt.03-08-2022 2/2 taking into consideration the allegations in the FIR, liberty granted to the petitioner in the earlier order of rejection dated 1.4.2022 and the petitioner being in custody for more than one year since 11.7.2021, the Court directs the petitioner to be enlarged on bail in connection with Atri P.S. Case no. 225 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IInd -cumSpecial Judge of Excise Act, Gaya.
