The petitioner seeks regular bail in connection with S.T. No. 13 of 2017 arising out of Bhagwanpur Hat P.S. Case No. 156 of 2016 registered for offences punishable under Sections 489B, 489C and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case as a quarrel took place at the betel shop and the owner of the shop has implicated the petitioner and even according to the allegation 11 notes of Rs. 100, 11 notes of Rs. 20 and 1 note of Rs. 50, total Rs. 1370/- has been recovered which is not the genuine rather counterfeit. The petitioner has remained in custody for about more than six months and he is a student.

Having heard both sides and in view of fact that the petitioner has remained in custody for about six months and charge sheet has already been submitted in this case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.2nd, Siwan in connection with S.T. No. 13 of 2017 arising out of Bhagwanpur Hat P.S. Case No. 156 of 2016 with the condition that the petitioner will co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be at liberty to move for cancellation of his bail bonds.

Accordingly, this application is allowed.
