Though the present writ petition has been filed for re-measurement of the height of the petitioner, in connection with Advertisement No.02 of 2019, issued by the Central Selection Board of Constable Recruitment, for recruitment of constables, however, the learned counsel for the respondentCentral Selection Board of Constable has referred to the counter affidavit, filed in the present case, more particularly, paragraphs no.11 and 12 thereof, to submit that the petitioner had appeared in the Physical Evaluation Test on 07.01.2021 and her height was found to be 154.1 cm, as against the minimum required height of 155 cm, whereafter she had filed an appeal, however,

Patna High Court CWJC No.15441 of 2021(2) dt.18-01-2024 2/2 again her height was found short i.e. 154.5 cm, thus she has been declared disqualified.

The aforesaid averments made in the counter affidavit have not been refuted by the petitioner inasmuch as no rejoinder affidavit has been filed, thus this Court finds that since the petitioner does not fulfill the required eligibility criteria, as her height is less than the required height i.e. 155 cm, she has been rightly disqualified, hence the present writ petition is bereft of any merit, thus the same stands dismissed.
