2. The petitioners seek bail in Madhepura P.S. Case No. 118 of 2024 registered for the offence punishable under Sections-363, 366(A), 323, 504,34 of the Indian Penal Code and Section-4 of POCSO Act.
3. It is alleged that the informant's minor daughter was kidnapped by the accused persons including the petitioners under threat of three-nut.
4. At the outset, learned Senior Counsel appearing for
Patna High Court CR. MISC. No.43326 of 2024(4) dt.07-10-2024 2/2 the petitioners has submitted that the victim in her statement recorded under Section 164 of the Cr.P.C. has stated that her mother has lodged false case against three persons because her mother wanted to solemnize marriage of the victim forcibly and it was the reason, she went to Delhi with her own sweet will. The petitioners are under incarceration since 09-02-2024.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI (Special Judge, POCSO), Madhepura in connection with Madhepura P.S. Case No. 118 of 2024 with condition that the petitioners shall cooperate with the trial of the case and make themselves available as and when required by the court.
