1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 103(1) and 3(5) of the BNS.

3. Learned counsel appearing on behalf of the petitioners submits that the defects as pointed out by the office stand removed as such the defects are ignored.

4. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. It is further submitted that the informant alleges that the accused persons including the petitioners during immersion of Lord Durga pulled her husband from the crowed and stabbed him to death.

5. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that though petitioners are named in the FIR but from perusal of the FIR, it would manifest that there is no specific allegation of assault or overt act against the petitioners rather the allegation of assault is general and omnibus in nature. It is next submitted that during the course of investigation, it transpired that one Ram Ishwar Manjhi (coaccused) inflicted the knife blow on the chest of the deceased. It is also submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence. It is submitted that similarly situated co-accused, namely, Mantosh Manjhi and Kamlesh Manjhi @ Amlesh Manjhi had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 37828 of 2025 and the same was allowed by a learned Coordinate Bench of this Court by an order dated 18.06.2025.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

7. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.53208 of 2025(2) dt.30-08-2025 3/3 anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Suppi P.S. Case No. 189 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.

8. However, if the investigating officer of the case files an application before the learned trial court bringing to its notice that the petitioners despite giving assurance to this Court are not cooperating in the investigation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioners.
