1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 110, 351(2) and 3(5) of the BNS.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on account of dispute relating to PACS election the accused persons came and the petitioners assaulted him by iron rod causing injury on his head.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to PACS election. It is

Patna High Court CR. MISC. No.37629 of 2025(2) dt.18-06-2025 2/2 further submitted that apart from petitioners, other accused have also been named in the FIR. It is next submitted that though there is allegation of assault but then the allegation is not specific.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners and submits that there is specific allegation against the petitioners of assaulting the informant by iron rod causing injury on his head. It is further submitted that from perusal of the order impugned, it would manifest that the same records that witnesses have supported the case in paras 5, 6 and 7 of the case diary, C.T. scan of brain of injured Ranjit Kumar shows hairline fracture on left parietal bone, a vital part of body and also it is dangerous to life.

6. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioners in connection with Narhat P.S. Case No. 37 of 2025 pending in the Court of learned Additional Chief Judicial Magistrate-VI, Nawada/Successor Court.
