The petitioner seeks regular bail in connection with Nabi Nagar P.S. Case No. 292 of 2017, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code. The allegation is regarding the accused persons having burnt the victim lady who is the wife of the petitioner herein resulting in her death.
The learned counsel for the petitioner submits that the F.I.R. would bear it out that the sister of the deceased lady has herself stated that when the petitioner had quarreled with the deceased lady, the deceased lady had put herself on fire. I have perused the case diary and find that the sister of the deceased lady, in Paragraph No. 5 of the case diary has stated
Patna High Court Cr.Misc. No.22261 of 2018(3) dt.02-07-2018 2/2 that the petitioner and other persons used to demand dowry and on account of non fulfillment of the demand for dowry, the petitioner and other accused persons had sprinkled kerosene oil on the victim lady and set her on fire. In fact, it is apparent from perusal of the case diary that the petitioner and other accused persons are responsible for putting the victim lady on fire and killing her.
Having regard to the facts and circumstances of the case, I do not find any merit in the present petition. Accordingly, the same is dismissed.
