====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 20-08-2016 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, namely, Raushan Kumar is in custody since 04.04.2016 in Gandhi Maidan P.S. Case No.491 of 2015 under Section 379 of the Indian Penal Code.

The F.I.R. is against unknown. Nothing has been recovered from the possession of the petitioner. The petitioner has been arrested only on suspicion. Confessional statement of coaccused was recorded wherein the name of this petitioner finds place. So far the criminal antecedent is concerned, the learned counsel submitted that the petitioner has been intentionally remanded in all those cases without there being any basis and only on suspicion. In all cases, he has already been granted bail.

Patna High Court Cr.Misc. No.35017 of 2016 (2) dt.20-08-2016 In view of the above facts and circumstances of the case, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Smt. Supriya Goshwami, J.M. 1st class, Patna in connection with Gandhi Maidan P.S. Case No.491 of 2015.
