JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is languishing in custody for the offences punishable under Sections 498A, 307, 324 and 326(A)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Later on, Section 304B of the Indian Penal Code was also added. There is general and omnibus allegation of demand of dowry and torture for the same against the petitioner also, who is mother-in-law. There is specific allegation of commission of assault by the petitioner. However, the victim died due to burn injury. Husband is already in custody.
Petitioner had earlier moved this Court for grant of anticipatory bail in Cr.Misc.No.31976 of 2016. Perused the order
Patna High Court Cr.Misc. No.11313 of 2017 (3) dt.18-04-2017 dated 23.08.2016 passed in the aforesaid criminal miscellaneous. Considering the entire facts and circumstances of this case, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa/Successor Court, in connection with (Saharsa) Mahila P.S. Case No.31 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
