The petitioner is in custody since 27.11.2017 in connection with Matihani P.S. Case No. 144 of 2017 for the offence registered under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been taken into custody on mere suspicion and there has been no recovery from his conscious possession. The alleged motorcycle was found near the Naya Goan Police Station and not from the petitioner.

Considering the aforesaid facts and circumstances of the case and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten
