Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366/34 of the I.P.C.

The accusation is of enticing away the married daughter of the informant by co-accused Pintu Bind. The petitioner is alleged to have associated Pintu Bind in commission of the offence.

It is submitted by learned counsel for the petitioner that victim in her 164 Cr.P.C statement got her age recorded as 16 years whereas learned Court below has assessed as 15 years where she stated that she of her own went in the company of Pintu Bind when the victim has not named this petitioner.

Patna High Court Cr.Misc. No.45542 of 2014 (2) dt.24-12-2014 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 151 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
