Petitioner is languishing in custody for the offences punishable under Sections 341/323/384/385/498A/504 of the Indian Penal Code and Sections 65/66/66A of the I.T. Act, 2008.
This is a case under Section under Section 498A of the Indian Penal Code. The petitioner is husband of the informant. He is ready for restoration of conjugal life. However, the informant opposes the prayer on the ground that in Maintenance Case No.75 of 2015, the learned Principal Judge, Family Court, Saran, has awarded Rs.4,000/- per month as maintenance besides litigation costs as Rs.10,000/- by order dated 24.06.2016. That order has already gained finality but
Patna High Court Cr.Misc. No.8262 of 2017 (2) dt.07-03-2017 2/2 the petitioner is not complying the said order. Considering the facts and circumstances aforesaid, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/Successor Court, in connection with Sonpur P.S. Case No.227 of 2016, with condition that at the time of furnishing of the bail-bond, petitioner shall produce receipt of deposit of entire dues of maintenance amount. (Birendra Kumar, J) Mkr./- U T
