Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 330, 341, 353, 386, 387, 467, 120B of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.

It is alleged by the informant being B.D.O, Chakia that the accused persons robbed the informant and made assault when this petitioner tried to strangulate him by putting the towel round his neck to hang him with the tree. It is submitted by learned counsel for the petitioner that informant was on inimical terms with the petitioner as this petitioner made protest against the informant for mal practice during PACS election when the injury has been found to be simple in nature.

Patna High Court Cr.Misc. No.23757 of 2015 (2) dt.09-07-2015 2/2 A statement has been made in para 3 of the petition petitioner is accused in one other case which was lodged by the driver of the informant.

Considering the nature of injury, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Pipra P.S. Case No. 270 of 2014, pending in the Court of learned Additional Chief Judicial Magistrate, Motihari, East Champaran.

With the observations above, the application stands disposed off.
