JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-b) a/26/35 of the Arms Act.

Allegation is that on secret information police force reached at the house of Naresh Prasad and apprehended the accused persons including the petitioner and from their possession arms were recovered.

It has been submitted on behalf of the petitioner that he is in custody since 28.5.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. One loaded country made pistol is said to have been recovered from the possession of the petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.33130 of 2016 (3) dt.17-09-2016 2/2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi, in connection with Masaurhi P.S. Case no. 224 of 2016.
