The petitioner seeks bail in connection with Bahadurganj P.S. Case no. 290 of 2017 registered under Sections 341, 324, 326, 307, 452/34 of Indian Penal Code and Section 27 of the Arms Act.

FIR named accused, namely, Nafish is said to have resorted firing on stomach of husband of the informant along with two other unknown accused persons over business rivalry. It is submitted by learned counsel for the petitioner that petitioner is not named in the FIR. He has no concern with the aforesaid occurrence. He has been falsely implicated in this case due to dirty village politics. There is nothing in record

Patna High Court Cr.Misc. No.19803 of 2018(4) dt.24-05-2018 2/2 indicating complicity of the petitioner in the occurrence barring confessional statement of co-accused namely, Azhar Hussain and Barun Kumar. Moreover, said accused persons in their confessional statement have named Amit Kumar and Barun Kumar as assailant and described the petitioner as mediator. Petitioner has no concern with the aforesaid two accused persons and said Amit Kumar. He has been languishing in custody since 6.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case no. 290 of 2017.
