The petitioner being the husband of the complainant is languishing in custody since 7.4.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under sections 498A, 406/34 of the Indian Penal Code and 4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant and the investigation has already concluded.

Patna High Court Cr.Misc. No.31228 of 2016 (2) dt.27-07-2016 that on making false statement the petitioner was granted provisional anticipatory bail by this Court but the petitioner denies to keep the complainant before the learned court below and this fact has been noticed by the learned Sessions Judge in the impugned order.

Considering the nature of accusation and the fact that the investigation has already concluded, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Siwan in connection with Complaint Case No. 97/2014 corresponding to Tr.No. 2809/2016.
