ANJANA MISHRA ORAL ORDER 07-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.08.2017 in connection with G.R. Case No.2238 of 2017, arising out of Gogri P.S. Case No.345 of 2017, registered for the offence under Sections 25(1AA), 29, 31, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that admittedly, the seizure of the arms etc. were made from the open banana field and not from the conscious possession of the petitioner and the petitioner has already been in custody for nearly eight months.

In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court Cr.Misc. No.20508 of 2018 (3) dt.07-05-2018 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with G.R. Case No.2238 of 2017, arising out of Gogri P.S. Case No.345 of 2017.
