The petitioner seeks bail in Amarpur P.S. Case No. 420 of 2020, registered for the offence under Section 302, 307 & other ancilliary sections of the Indian Penal Code. As per the F.I.R., this petitioner alongwith other F.I.R. named accused persons assaulted the father of the informant by fists & slaps. It is further alleged that co-accused Saurav Kumar assaulted the father of the informant by axe on his head, on account of which, father of the informant died. It is submitted on behalf of petitioner that specific allegation of assault is against co-accused Saurav Kumar. So far as this petitioner is concerned, there is general and omnibus allegation. Similarly situated co-accused persons namely Raju

Patna High Court CR. MISC. No.49407 of 2021(2) dt.24-01-2022 2/2 Kumar and Mithun Kumar have already been granted bail by this Court, vide order dated 22.03.2021 passed in Cr.Misc. No. 3998 of 2021 (Annexure 2). Petitioner has got clean antecedent and he is in custody since 01.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka / concerned court in connection with Amarpur P.S. Case No. 420 of 2020.
