The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 386, 353, 341, 323, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, petitioner and co-accused Ajay Sah are alleged to have demanded Rangdari of Rs. Five lakhs and on refusal they stopped the construction work and threatened the informant with dire consequence. It is submitted that petitioner is husband of Panchayat member whereas informant is Panchayat Secretary of the Panchayat. As a matter of fact, this petitioner was protesting against the construction of Panchayat Bhawan as the material

Patna High Court CR. MISC. No.40199 of 2022(2) dt.28-11-2022 2/2 which was being used in construction was of inferior quality due to that reason this false and concocted case has been lodged against the petitioner. In this regard, prior to the lodging of FIR, petitioner has filed a petition before the higher authority demanding inquiry against the informant. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Udakishunganj, Madhepura in connection with Gwalpara P.S.
