This is repeat application seeking bail in connection with Bidupur P.S. Case No. 220 of 2016, registered under Section 394 of the IPC.
On 19.08.2016, the petitioner, Ranjeet Kumar and Chandan Kumar were arrested on the confessional statement of some other accused(s). From the possession of the petitioner a sum of Rs. 10,000/- was recovered which was allegedly looted from the petrol pump.
Learned counsel for the petitioner submits that vide order dated 24.03.2017 co -accused Ranjeet Kumar from whose possession similar amount was recovered and who was arrested along with petitioner has since been released on bail. It is submitted that the case of the petitioner stands on identical
Patna High Court Cr.Misc. No.17031 of 2017 (4) dt.21-06-2017 2/2 footing. The petitioner is in custody since 19.08.2016. He has only one criminal case to his credit.
Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. case No. 220 of 2016, subject to the following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.
(ii) No sooner the charges are framed the petitioner shall continue to appear before the Court below in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
