The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 366(A)/34 of the Indian Penal Code.

The allegation against the accused including the petitioners is to have kidnapped the minor daughter of the informant for the purpose of marriage.

On behalf of the petitioners, it is submitted that the petitioners have got no criminal antecedent. There is no specific allegation against them in the present case. The other co-accused of this case has been acquitted by the trial court.

Patna High Court Cr.Misc. No.23638 of 2015 (3) dt.02-09-2015 2/2 On behalf of the State, it is submitted that the petitioners are named in the First Information Report and the victim is still traceless.

Considering the aforesaid facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners and the same is rejected.

However, if the petitioners surrender in the court below within a period of four weeks, the same shall be considered on its own merit without being prejudiced by this order. The court below may consider the submissions made on behalf of the petitioners while passing the order.
