The petitioner is languishing in judicial custody since 24.01.2018 in connection with Special Case No. 604 of 2018 arising out of Alamganj P.R. P.S. Case No. 229 of 2018 for offences punishable under Sections 30(a) & 37(b) of Excise Act. The prosecution case as lodged by the informant, police personnel is that 35 litres of toddy was recovered near house of the petitioner in the raid.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has falsely been implicated in the aforesaid case. Nothing has been recovered from his conscious possession and that that charge sheet has already been submitted and there is no

Patna High Court Cr.Misc. No.20516 of 2018 (3) dt.10-05-2018 allegation of tampering of the prosecution witnesses. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousands) each, with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 604 of 2018 arising out of Alamganj P.R. P.S. Case No. 229 of 2018.
