This application is for grant of bail in connection with Bathnaha P.S.Case No.104 of 2016 for the offence under Section 392 of the Indian Penal Code.

It is submitted on behalf of the petitioner that on the basis of confessional statement of the co-accused, the petitioner has been made accused in this case and nothing has been recovered from the possession of the petitioner. He is in custody since 13.08.2016 and the petitioner has criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for bail, stating that the informant has identified this petitioner. Having heard both sides and in view of submission as above, I am not inclined to grant bail to the petitioner at this stage,

Patna High Court Cr.Misc. No.10897 of 2017 (3) dt.22-03-2017 2/2 however, considering the fact that he is in custody for a long period, the learned trial court is directed to expedite the trial and try to conclude it within a period of seven months. At the same time, the S.P., Sitamarhi is directed to ensure attendance of the witnesses in the court.

With the aforesaid observation, this application is dismissed.
