The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30 (a) and 38 of the Bihar Prohibition and Excise Act, 2016. There is no recovery from the conscious possession of the petitioner and in para 3 of the bail petition petitioner is an accused in P.S. Case No. 191/2017 under Sections 272, 273 and 30 of the Excise Act.

In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Daraundha/Daraunda P.S. Case No. 53 of 2019 from the Court

Patna High Court CR. MISC. No.36280 of 2019(3) dt.14-08-2019 2/2 of learned Addl. Sessions Judge-IInd, (Special Judge, Excise Act), Siwan.

Accordingly, the application is dismissed.
