JUSTICE RAKESH KUMAR ORAL ORDER 28-11-2016 Heard Sri Ranjit Jha, learned counsel for the petitioner and Sri Ajay Kumar -1, learned Additional Public Prosecutor. This is second attempt for grant of bail. Earlier, prayer for bail of the petitioner was rejected on 15.9.2015 vide Cr. Misc. No. 42713 of 2015 . It was submitted by learned counsel for the petitioner that petitioner is the brother of the husband of the deceased and is in custody since 26.6.2014 in Nautan P.S. Case No. 151 of 2014 registered for the offence Under Section 341, 307, 498-A/34 of the Indian Penal Code. Subsequently, Section 304-B / 34 of the Indian Penal Code was added. It was submitted by learned counsel for the petitioner that father -in- law of the deceased has been granted bail vide Cr. Misc. No. 41628 of 2014 on 21.1.2015 .

No.38645 of 2016 (4) dt.28-11-2016 2/2 In this case a report was called for from the court below regarding the stage of the case which has been received and kept at flag -'A'. On perusal of the report dated 26.10.2016 it is evident that case has not been committed to the court of Sessions and it is pending for supply of Police Paper . Considering the fact that petitioner is in custody since long and case is at stage of supply of police paper itself, there is no reason to further detain the petitioner.

Let the petitioner Jayad @ Zahid Alam @ Zaid Alam be enlarged on bail on furnishing bail bond of Rs. 10000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri S.D. Bharti, Judicial Magistrate 1st Class, Bettiah ( West Champaran) in connection with Nautan Town P.S. Case No. 151 of 2014 and Trial No. 3731 of 2015. (Rakesh Kumar, J) Praful/- U T
