JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 448, 341, 323, 504 and 364/34 of the I.P.C The petitioner is named in the First Information Report but only on the basis of suspicion on the ground that on 22.08.2014 the petitioner and others had come at the house of the informant and started searching her son and when they could not succeed to trace him out, they threatened the informant to teach a lesson to her son and since then her son was found missing. Submission is of false implication and according to the prosecution case itself, when the petitioner and others went at the house of the informant, the informant disclosed that her son

Patna High Court Cr.Misc. No.19259 of 2017 (3) dt.25-05-2017 2/2 was missing prior to one week of 22.08.2014, there is no specific material against the petitioner besides suspicion, Laddu Dhangar against whom there is specific allegation has already been allowed bail vide Cr. Misc. No. 31524 of 2015 by order dated 13.08.2015, vide Annexure-2 and further co-accused Devkali Devi and other co-accused have been allowed pre-arrest bail and as such the petitioner who is suffering in custody since 15.02.2017 also deserves sympathetic consideration.

The learned A.P.P. submits that Laddu Dhangar has already been allowed bail.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. West Champaran at Bettiah in Bettiah Muffasil P.S. Case No. 465 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
