1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code.
3. The informant alleges that he solemnized marriage of his daughter with Abhishek, thereafter, it is alleged that she was being tortured for non-fulfillment of demand of Rs. 5,00,000/- by way of dowry and accordingly he came to know on 08.11.2022, that his daughter was killed by the named accused persons including the
Patna High Court CR. MISC. No.40458 of 2023(2) dt.02-08-2023 2/3 petitioners by strangulating her.
4. The learned counsel for the petitioners submits that petitioners are persons with clean antecedent and have been falsely implicated in the present case, it is next submitted that petitioner no. 1 is mother-in-law, petitioner no. 2 is brother-in-law and petitioner no. 3 is sister-in-law of the deceased. It is next submitted that whenever such occurrence takes place the entire family members are implicated in a mechanical manner. It is further submitted that sister-in-law is married and resides separately like the brother-in-law and the mother-in-law who are also residing separately, it is next submitted that husband is in custody and even the allegation of demand and torture is general and omnibus in nature.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of
Patna High Court CR. MISC. No.40458 of 2023(2) dt.02-08-2023 3/3 Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Patepur P.S. Case No. 292 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
