JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 304B and 349/34 of the I.P.C. The prosecution case is that the daughter of the informant was killed by the accused persons including the petitioner after two years of marriage for non-fulfilment of dowry by administering poison.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.12.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. In paragraph 25 of the case
Patna High Court Cr.Misc. No.29844 of 2016 (4) dt.27-09-2016 diary the independent witness has stated that there was hot exchange of words between the petitioner and his wife and subsequently the wife took poison. It is at best a case for offence under Section 306 I.P.C.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R. and is the husband of the deceased.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Silao P.S. case No.163 of 2015.
