The petitioner seeks bail in connection with Kusheshwar Asthan P.S. Case No. 21 of 2025 instituted for the offence under Sections 103(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

Prosecution case in a nutshell is that, the petitioner along with co-accused allegedly shot and killed the brother of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25-03-2025. Petitioner bears three criminal antecedents, as per disclosure made in

Patna High Court CR. MISC. No.39749 of 2025(4) dt.03-09-2025 2/3 paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no eye witness to the occurrence. Petitioner has been roped in this case on mere suspicion. As per confessional statement of co-accused, namely, Ranjan Yadav, he has stated that co-accused, namely, Subodh, Mukesh and Sudarshan fired upon the deceased. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is fervently submitted that it is the petitioner who has given the contract for killing, hence, he is the primary conspirator in the commission of the alleged offence. Moreover, as per postmortem report, caused of death is due to injuries sustained by three fire arm shot.

Considering the aforesaid facts and circumstances of the case, there being ample material against the petitioner to establish his role in the commission of the offence, this Court at this stage is not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected at this stage. 8.

The Trial Court is directed to expedite the trial as

Patna High Court CR. MISC. No.39749 of 2025(4) dt.03-09-2025 3/3 expeditiously as possible without any undue delay and unnecessary adjournments.

However, petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within a period of six months from today.
