The petitioner is accused in connection with Mahishi P.S. Case No. 35 of 2016, registered under Section 273 of the Indian Penal Code and Section 47 of the Excise Act. The accusation is that petitioner was found in possession of five bottles of foreign liquor each containing 375 ML.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent is in custody since 27.06.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.34066 of 2016 (2) dt.17-08-2016 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Saharsa in connection with Mahishi P.S. Case No. 35 of 2016.
