JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Sections 364, 302, 201, 34 and 120(B) of the Indian Penal Code.

It is alleged by the informant that on 23.03.2013 a dead body of an unknown person was lying on Hajipur-Jandaha main road near Aman Chain hotel. In the night the patrolling Chowkidar got information about the aforesaid fact and gave information to his SHO that a person who was met with an accident is lying on the road and local people are gathered. Nobody could identify the dead body and the informant has claimed that due to rash and negligent driving of the driver the said accident had taken place.

Patna High Court Cr.Misc. No.22774 of 2015 (3) dt.21-09-2015 Learned counsel for the petitioner submits that petitioner has got no criminal antecedent. It has been submitted that the petitioner is a lady and there is no specific allegation against her. From perusal of the FIR, it appears that the deceased was last seen with Garib Nath and Dinesh Singh. On behalf of the State, it has been submitted that there is no specific allegation against her.

Considering the aforesaid facts, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Desari P.S.Case No.165 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
