Petitioner being lady is languishing in jail custody since 4.03.2016 in a case registered under section 364/120(B) of the Indian Penal Code and section 302/34 of the Indian Penal Code was also added.

It would appear from perusal of the impugned order that in course of investigation, witnesses claimed to have seen the co-accused as well as petitioner taking away the victim but admittedly, not a single witness claimed to have seen the actual killing of the deceased. Moreover, co-accused Rani Devi having more or less similar allegation has already been granted privilege

Patna High Court Cr.Misc. No.29949 of 2016 (2) dt.29-07-2016 2/2 of bail by this Court.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Siwan in connection with Daraunda P.S.No. 34 of 2016.
