The petitioners seek bail in Pachrukhi (Sarai) P.S. Case No. 199 of 2016 under Section 379 of the Indian Penal Code.

The petitioners are not named in the First Information Report. The names of the petitioners are said to have been disclosed by spy of the police on the basis of photographs of C.C.T.V footage. Co-accused Nitish Kumar was apprehended and he is said to have disclosed the name of petitioners as his associates.

It is submitted by learned counsel for the petitioners that nothing has been recovered from the possession of

Patna High Court Cr.Misc. No.14914 of 2017 (2) dt.19-04-2017 2/2 the petitioners. The petitioners are in custody since 25.01.2017 and they have not been put on Test Identification Parade. Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Siwan in connection with Pachrukhi(Sarai) P.S. Case No. 199 of 2016.
