JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 25(1-b)a, 26 and 35 of Arms Act.

The allegation against the petitioner is that one country made loaded pistol was recovered from his possession. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.04.2016. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioner. One country made loaded pistol is said to have recovered from the possession of the petitioner. There is no compliance of Section 100 Cr.P.C. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Patna High Court Cr.Misc. No.34081 of 2016 (3) dt.27-09-2016 2/2 Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kihsore, learned Judicial Magistrate,1st Class, Begusarai in connection with Phulwaria P.S.Case No. 86 of 2016.
