JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

It is said that the petitioner was caught raid handed while he was removing cash of Rs.17,500/- and mobile phones from the pocket of the informant and it is also stated that he had also removed Rs.6,500/- from one Santosh Kumar and others. Submission on behalf of the counsel for the petitioner is that an altercation had taken place between the informant and petitioner on the point of seating in a train and after that, informant with the help of police, lodged this false case

Patna High Court Cr.Misc. No.29897 of 2016 (2) dt.28-07-2016 2/2 against the petitioner and the so called stolen amount of Rs.17,500/- was not recovered from the possession of the petitioner. So far as Rs.6,500/- is concerned, the same was of the petitioner.

No doubt, the petitioner carries criminal antecedents but taking note of the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, in connection with Chapra Rail P.S.
