JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, neither petitioner was caught on the spot nor any firearm was recovered from his conscious possession. The apprehended co-accused disclosed that this petitioner had provided his Alto car for committing the alleged crime and Alto car of the petitioner was seized on the spot but according to the confessional statements of the aforesaid apprehended co-accused, petitioner had not participated in the alleged crime except providing his Alto car to other co-accused for committing the alleged crime. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Samastipur in connection with Samastipur P.S.Case No. 93 of 2016.
