1. Heard learned counsel for petitioner and learned Additional Public Prosecutor.

2. Learned counsel for the petitioner has handed over two cheque of Rs. 10 lakh each total of Rs. 20 lakh to the learned counsel for the opposite party no. 2 in addition to the earlier payment of Rs. 20,30,000/-. The balance amount of Rs. 9,70,000/- shall be paid to the opposite party no. 2 after the second motion in the divorce case.

3. The learned counsel for both the parties undertake before this Court that both the parties will cooperate in the divorce proceeding in the Court of Principle Judge, Family Court, Sasaram and on the date of second motion,

Patna High Court CR. MISC. No.40187 of 2022(6) dt.17-07-2023 2/2 the Principal Judge will ensure that the amount of Rs. 9,70,000/- is paid to the opposite party no. 2 in Court.

4. In view of the above settlement between the parties the following cases are hereby quashed.

• Divorce Case No. 364 of 2019 pending before Principal Judge Family, Court, Sasaram.

• Rohtas Mahila P.S. Case No. 65/2019 Dehri pending before Sub Divisional Judicial Magistrate, Sasaram • Maintenance Case No. 87/2020 pending iin the Court of Principal Judge Family Court, Sasaram • Including the present case i.e. Mahila P.S. Case No. 65/2019 passed by learned Sub Divisional Judicial Magistrate, Sasaram is hereby quashed.

The parties will appear in the Court of Principal Judge Family Court, Sasaram on 01.08.2023 and thereafter the divorce proceeding shall be concluded at the earliest. (Sandeep Kumar, J) Sunnykr/- U T
