JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offence punishable under Sections 406, 409, 419, 420, 465, 467, 468, 471, 201, and 374/34 of the of the Indian Penal Code.

The petitioner, at the relevant point of time, was posted as Junior Engineer and he was engaged in implementation of MANREGA Scheme. The allegation in the First Information Report, is of making fake payments under the Scheme. Learned counsel for the petitioner at very outset has drawn my attention to orders passed by this Court granting anticipatory bail to other accused persons involved in the same case. Reference has been made in this regard to Cr. Misc. No. 1255 of

Patna High Court Cr.Misc. No.46681 of 2013 (5) dt.20-01-2015 2014, Cr. Misc. No. 35265 of 2013, Cr. Misc. No. 6464 of 2014 and Cr. Misc. No. 8095 of 2014 disposed of on 24.12.2014, 13.12.2013, 23.06.2014 and 25.04.2014.

Learned Assistant Public Prosecutor appearing on behalf of the State does not dispute the submission that the petitioner is similarly situated to those who have been granted the privilege of anticipatory bail vide orders of this Court as noted above. In view of the above, let the petitioner Sanjay Kiran, in the event of his arrest / surrender within six weeks from today before the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount, each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Sangrampur P.S. Case No. 32/13, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
