JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 409, 420, 467, 468/34 of the Indian Penal Code.

Allegation against the petitioner is that he has withdrawn money by using forged means of Dargahi Panchayat Scheme no. 11/10-11.

It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. Petitioner has been made accused in the present case due to mistake of fact. It is further submitted that he is ready to deposit an amount of Rs.20,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioner is also a party with regard to misappropriation of public fund. Considering the aforesaid facts, it is directed that he shall deposit an amount of 20,000/- in the court below which shall

Singh, learned Judicial Magistrate, Ist Class, Araria, in connection with Narpatganj P.S. Case no. 89 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
