JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.
It is alleged that the petitioner being the Principal of the Teachers' Training College, Turki, did not hand over charge to his successor. In a departmental proceeding the petitioner has been visited with punishment of compulsory retirement from service. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail provisionally for three months in the event of arrest or surrender before the learned Court below within a period of eight weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.13562 of 2015 (2) dt.07-05-2015 2/2 amount each to the satisfaction of learned SDJM, West Muzaffarpur in connection with Kurhani P.S. Case No. 72 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail will be confirmed by the learned court below when the present incumbent in the Teachers' Training College, Turki gives a certificate that the petitioner has handed over complete charge.
